1. Agreement to Terms

By accessing or using timeearusea.art ("Website"), purchasing products, or subscribing to services offered by Timeea Rusea Art ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Eligibility

You must be at least 18 years old to make purchases or subscribe to our services. By placing an order, you represent that you are of legal age and have the legal capacity to enter into binding contracts.

3. Products and Services

Original artworks are one-of-a-kind pieces sold "as is" with accurate descriptions provided. Prints are reproductions available in limited or unlimited quantities as specified. Monthly subscriptions provide exclusive A5 prints delivered worldwide and renew automatically until cancelled. Colors may vary slightly due to screen displays and printing processes.

4. Pricing and Payment

All prices are listed in the specified currency (RON or USD) and include applicable VAT/taxes. Payments are processed securely through Stripe. We reserve the right to change prices, but changes will not affect orders already placed. If subscription payments fail repeatedly, your subscription may be suspended or cancelled.

5. Shipping and Delivery

We ship worldwide from Romania with exceptions for countries subject to postal restrictions or international sanctions. Delivery times are estimates and not guaranteed, as they depend on postal services, customs processing, and circumstances beyond our control. You are responsible for providing accurate shipping information and for all customs duties, import taxes, and fees imposed by your country. We are not liable for delays, additional charges, or items returned due to customs issues or incorrect addresses.

6. Lost or Damaged Items

Items are carefully packaged to prevent damage. If your item arrives damaged or does not arrive within the expected timeframe plus 14 days, contact us within 7 days of expected delivery (for lost items) or within 7 days of receipt (for damaged items). We will work with you to resolve the issue through replacement or refund, subject to verification. Photographic evidence may be required for damaged items.

7. Returns and Refunds

Subscription fees are non-refundable except when monthly prints are not delivered. You may cancel anytime, effective at the end of the current billing period. Original artwork returns are evaluated case-by-case within 7 days of delivery; if approved, return shipping costs and a 20% restocking fee may apply. For damaged or defective items, we will provide replacements at no cost when reported within 7 days of receipt with photographic evidence. Approved refunds are processed within 10 business days. Shipping costs are non-refundable unless the return is due to our error.

8. Cancellations

Orders may be cancelled within 24 hours of placement if not yet shipped. Subscriptions may be cancelled anytime through your account or by contacting us, taking effect at the end of the current billing period with no refunds for the current period.

9. Intellectual Property Rights

All artwork, images, designs, and content are protected by copyright and owned by Timeea Rusea Art. Purchasing a physical artwork or print does not transfer intellectual property rights, reproduction rights, or commercial use rights. Items are for personal, non-commercial use only. You may not reproduce, distribute, publicly display, or create derivative works without explicit written permission.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount you paid for the specific product or service, or 100 EUR, whichever is greater. We are not liable for delays, loss, or damage caused by postal services, customs authorities, shipping carriers, or force majeure events including natural disasters, war, pandemics, strikes, or other circumstances beyond our reasonable control.

11. Disclaimers

We strive to provide accurate product descriptions and images but do not warrant they are error-free. Colors may vary due to screen displays and printing processes. All products are subject to availability and we reserve the right to discontinue any product. We do not guarantee the Website will be available at all times or free from errors.

12. User Conduct

You agree not to use the Website for unlawful purposes, attempt unauthorized access, interfere with or disrupt the Website, use automated systems without permission, impersonate others, collect information without permission, or submit false information. You are responsible for maintaining account security and must notify us immediately of any unauthorized use.

13. Dispute Resolution

These Terms are governed by the laws of Romania. Any disputes shall be subject to the exclusive jurisdiction of Romanian courts. Before initiating formal legal proceedings, you agree to contact us to attempt informal resolution.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting with an updated date. Your continued use after changes constitutes acceptance. Material changes affecting subscriptions will be communicated to active subscribers.

15. General Provisions

If any provision is found unenforceable, it shall be limited to the minimum extent necessary while remaining provisions stay in effect. These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement. Our failure to enforce any right does not constitute a waiver. These Terms are provided in English, which shall prevail in case of discrepancies with translations.
